These Terms & Conditions govern the use of FindOpps powered by Hopewiser, which sources leads based on publicly available information and assists in generating outreach emails. By using this Service, you agree to comply with these Terms.

2. Service Description

The Service:

• Searches publicly accessible news and websites for stories related to specified company criteria.
• Identifies relevant job titles and contact names using publicly available sources such as LinkedIn and RocketReach.
• Uses AI to draft suggested email content for outreach, which must be reviewed and sent by the Sales Representative.

3. Data Sources & Compliance

• All data is collected from publicly available sources.
• Contact details and LinkedIn information displayed in the app originate from RocketReach; email addresses are sourced via AnyMailFinder.
• Users are responsible for ensuring compliance with applicable laws, including GDPR and other data protection regulations when contacting individuals.

4. Third-Party Data Processing

To provide the Service, certain data is shared with trusted third-party providers:

• OpenAI:
  • Company description entered by the user
  • Additional instructions for drafting messages
  • Current message draft and subject line when using “Draft Message”
• RocketReach:
  • Search terms for contacts (e.g., “CEO”)
• AnyMailFinder:
  • Name, role, and employer of the contact for email lookup

Aside from the company description, no other data is transferred to third parties.

5. Data Stored by FindOpps

• Company name, address, and description
• User email addresses
• Usage logs (e.g., actions such as scoring an article)
• Credits
• Cookies (strictly necessary for authentication; ICO guidance states no consent popup required)

6. GDPR Compliance

• Lawful Basis: Users must ensure they have a lawful basis for processing personal data (e.g., legitimate interest for B2B marketing).
• Transparency: Outreach emails must clearly identify the sender and purpose of contact.
• Right to Object: Recipients must be provided with a clear and easy way to opt out of future communications.
• Data Minimisation: Only necessary personal data (e.g., name, job title, business email) should be processed.
• Retention: Personal data should not be retained longer than necessary for the intended purpose.
• Security: Appropriate technical and organisational measures must be implemented to protect personal data.

7. User Responsibilities

• Review and approve all AI-generated email content before sending.
• Ensure outreach complies with relevant marketing and privacy laws.
• Do not use the Service for unlawful, discriminatory, or unethical purposes.

8. Limitations of Liability

The Service provides lead information “as is” and does not guarantee accuracy, completeness, or conversion results. Hopewiser Ltd is not liable for any damages arising from the use of the Service, including reputational or financial loss.

9. Intellectual Property

AI-generated email drafts are provided for your use but remain subject to copyright and intellectual property laws. You may not resell or redistribute the Service or its outputs without prior written consent.

10. Privacy & Data Handling

The Service does not store personal data beyond what is necessary for lead generation and email drafting. Users must handle all personal data in accordance with applicable privacy regulations, including GDPR.

11. Termination

Hopewiser Ltd reserves the right to suspend or terminate access to the Service for violations of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The United Kingdom.
